POSITION DESCRIPTION:
1. Provide legal advice on matters relating to consumer collections, recovery, bankruptcy, foreclosure, default mortgage servicing, loss mitigation, escrow, mortgage servicing, customer complaints, credit reporting, and real estate owned.
2. Review, interpret, analyze and provide guidance on federal and state first and third party collection, consumer credit, credit reporting/data furnishing, and consumer protection legislation, regulation, agency guidance, judicial decisions, and industry trends relating to the bank's activities.
3. Periodically review and update the content of customer-facing letters based on changes in regulation and/or industry best practices and communicates necessary timelines to ensure all documents contain the required content to maintain regulatory compliance.
4. Review documentation (including policies, procedures, correspondence, customer communications, and contracts) to provide quality control in the consumer debt collections process.
5. Partner with legal and business teams to identify and analyze new legislative and regulatory requirements and provide gap analyses against current Mortgage Banking and other business team practices.
6. Provide legal support to mortgage servicing business team relating to consumer protection laws and regulations governing residential mortgage activities, including TILA and RESPA, FDCPA, ECOA, FCRA and other applicable laws and rules.
7. Maintain current knowledge of, and prepare analyses and responses to, legislative, regulatory and industry developments in relevant areas.
8. Exercise discretion and independent judgment in relation to regulatory and compliance related matters.
9. Perform other duties as may arise in support of the goals of the department and company.
10. Research and analyze legal issues and render legal opinions.
11. Identify legal, regulatory, and other risk issues and advise business teams on same.
12. Coordinate and assist in representation of the company in legal disputes.
13. Perform related duties as assigned.
Qualifications
Qualifications:
1. For a Corporate Counsel I, two or more years of relevant experience in a law firm environment or relevant in-house financial services corporate legal practice will be considered to be eligible experience to include experience and knowledge of state and federal consumer finance regulations including TILA/Reg Z, Reg B, Reg E, FCRA, privacy and usury laws in the areas of credit cards, debit cards, prepaid cards, consumer secured and unsecured loans, and/or data management. For Corporate Counsel II, six or more years of experience and knowledge in the afore-mentioned areas.
2. Must be a licensed U.S. attorney in good standing with applicable state bar association.
3. Must have a Juris Doctorate or equivalent from an accredited law school.
4. Requires the ability to apply and/or interpret a specialized field composed of technical or general business principles, practices and techniques.
5. Requires excellent interpersonal, verbal and written communication skills.
6. For Corporate Counsel I, must have the ability to work with minimal supervision.
7. Must have the ability to work independently at the Corporate Counsel II level.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
